2 brothers and I own home. One brother's hospital bill caused a lien. How do we sell?

We would like to sell the home, but the hospital put a lien for 29,000 against the home because of my brothers bill. Does the entire 29,000 have to be repaid or just the portion of money that he would receive from the sale?

The lien is paid before the house can be sold (minutes, happens at closing). It does not matter what his share is, the banks share is 29k.

This is a problem with multiple parties on a deed as tenants in common



The lien encumbrance the whole property, you will not be able to get clear title to sell to a third party unless the entire amount of the lien is paid off , its immaterial which title owner the actual judgment is against, the home is an asset , you can not sell the home without first paying off the lien as toward the one brother not having enough money that is between the title owners but the lien will have to be paid off by all parties then make payment arraignments for the one brother to pay the others back



Note: up to the sell if any of the other parties in the deed get in trouble with finances , additional liens can be filed on the property making it worthless to all on the title

Seriously?

You pay the 29,000 lien off at closing. That should be deducted from the brother's 1/3 share of the sale proceeds.

don't sell for that reason. you can get charity help for the purpose of paying off medical bills. those grants are pretty easy to get. a lot easier than selling the house and pocketing 30k less.
