I don't see a reason anyone can sue you for being late paying rent, that isnt any type of civil action that can be sued. If you dont pay, then you get eviction papers like the above answers says. But you cant be sued for late payments, I mean if you already paid, how can you be sued for something you already paid.

The landlord will win the case against and you will have to pay rent owed.

If he has not filed eviction against you, he probably will soon.

Every state/province/country has its own laws regarding residential tenancy. Where I live, you can't be sued for late payment. Your landlord can give you 5 days notice to pay the rent. If within 5 days you don't pay, your landlord is entitled to evict you. Even if you consistently are late on payments and have to be given 5 days notice each time, s/he still can't evict you because in the end you complied. But if you haven't been paying and are squatting, then s/he can evict you. I've rarely heard of landlord suing unless you are squatting and refuse to leave.
