Question:
Kicking out my roommate who's not on the lease.... Need some advise??! ?

I really need some help. I'm a 22 year old college student in a messy apartment situation. This is in the state of West Virginia. 

Currently I have a 1 year lease with a local student. The lease ran from May 2010- May 2011. The girl who orignally signed the lease with me decided that she wanted to transfer and moved out in Nov with out having somone sublet the house. 

A guy moved in a week after the girl left and never signed a new lease or any sublet forms for the apartment. 

He has broken all the house rules that we set up... Those are keeping the living room cleaned, not doing drugs or smoking in the apartment. I found pills for ppl who have sketsaphrina (however you spell it) smashed on my coffee table. He left some solid pills on the table and a quick google search told me what type of pill it was. And always smokes in my apartment. Unfortantly I found these pills the day I was leaving for the hollidays. 

Last but not least he hasn't paid rent since he's moved in since January. My landlord wants him out, and I'm extremly pissed off and I really don't know how to kindly tell him he can't live w me anymore. 

I'm not a pushover but Im just not trying to make enimies here and worried about how hes going to react... How would any of you go about kicking him out tomorrow? I'm still on break and won't be back home tomorrow....

How would you go about kicking him out. I already have new locks ready to install.

I'm not sure if you are a man or a woman so it's kind of difficult to direct you towards the right answer...



I remember my last roommate, how much of a pain he was, how we let little things slide for too long until it reached a boiling point and I ended up picking him off the ground and body slamming him on the front porch...



It's better to nip it in the bud right away and not allow this nonsense to continue. Sit him down and have an adult conversation, just put it all out there, just DON'T ARGUE. You may be frustrated, and he may say things to antagonize you, but keep your cool, voice your concerns in a mature fashion and give him an ultimatum. Either he pays and follows the rules or he has to go... Since he is not on a lease it will be easier (from a legal standpoint) I would give him roughly a 2-week notice that he is being asked to leave and must look for another place to live. Keep in mind that he may try to steal things or damage things within those 2 weeks. Don't let some jerk off ruin your college experience, separate him from your life, the sooner the better. True story. And next time be a little more mindful of who you allow to move into your home.



P.S. Sounds like you would be better off just getting rid of this dude and moving on, life is too short to be around people that make your life, especially your living situation, difficult.

Who let him move in? It wasn't the landlord. I throw YOU and / or YOUR roommates out, YOU let him in there. YOU are permitting "drug abuse" there. Again, I would throw YOU out. Here in Ohio, the law doesn't care about who YOU may or may not have let move in, YOU are responsible. YOU are subletting to him, whether he pays rent or not. HE is breaking YOUR rules. THROW THE BUM OUT! Tell him to straighten up, pay up or else! Call the police on his drug abusing a$$! (You could wait until they are all sitting there, stoned.) YOU agreed to any "standard" verbal agreement / state / local laws / case (court rulings) law involving rental property, by letting him move in. He IS NOT holding up his end of the "bargain", AND YOU opened a big, messy, stinky can of worms, by not getting anything in writing. Take a $100 & go see a local lawyer! Some lawyers give free consultation. See if you can give a "3 day notice". Then change the locks. If you call the police about the drugs, then he breaks the door, HE will be in trouble. If you change the locks without any notice, he COULD sue you, he IS subletting from you. IF not, HE could TRASH the place & YOU & your ROOMMATE could be stuck with the BILL!!!!! No offense, the word is schizophrenia (sorry, I can get it close enough for the spell check to pick it up). I'm not really trying to pi$$ you off. Just trying to tell it like it is. You are correct to say "messy"!

hes not on the lease so you have the police come-over when you are about to kick him out of the house just in case he refuse to move out or gets violant with you, that way you will have additional witnesses. Make sure you have all yuor paper work stating who is on the lease when the police officer comes-over & I would have the landlord their just in case. Just a warning about Schizophrenia's, they tend to be extremely paranoid and dilusional even if they seem to act normal, so I would be extra careful and make sure that when you do this that he will not have a chance to come back at all, b/c you might have to keep one eye-open when your sleeping at night. I just watched forensic science last night about a girl who was Schizophrenia and thought her boyfriend was trying to kill her when he was trying to end the relationship with her and she end up killing him with a claw hammer.
