So I was renting an apartment with my boyfriend I was pregnant when we moved in, I didn t know anything about moving into an apartment so I thought I was just being put on the application as someone living with him and he would just be on the lease on his own, I moved out 6 months later because I couldn t hadle the stress of the relationship and he said fine leave so I did he agreed to stay there and just have that extra room for our son whenever he would visit. So he lied once again, and I found out by receiving a letter from the apartment manager saying we were both going to court. Now I m stuck I can t rent an apartment without getting denied. I know it will go away in 7 years but I m not trying to rent a room for 7 years. I also make payments to them every month, auto payments too. And on my credit report its not on my public records so what does that mean? I don t have an eviction?

You asked what you could do to get the eviction removed and then you said you do not have an eviction. It sounds like you do have an eviction on your record. That will never go away. You are confusing it with a bankruptcy. All adults living at an apartment must be on the lease. Otherwise, they are illegally living there. You generally cannot just move in with someone, without getting approved by the landlord and put on the lease. However, you stated that you got the place together so, you should have known that you both rented it. If it took both of your incomes to be approved, then you are equally responsible for the rent, whether you stay for the duration of the lease or whether you move out early. If the landlord will let you out of the lease fine but, you did not even ask. Evictions ARE of public record, for life and after you die. Those records can never be changed. However, once you (and/or your boyfriend) have paid off the debt, you can inform the court and send in proof of payment in full and ask them to update their records i.e., if the landlord does not do it and then, anyone looking will at least see that the debt has been paid in full. But the record remains. Also, you must have known that he was no longer living there. Did you deliver your son to a stranger living there or to an empty apartment? It sounds more like you were not in good communication with the bf. Next time, don 't assume and don 't take things for granted.

I don't mean this answer to sound mean, but its going to sound like it.

Ignorance is not a valid defense. And in all actuality you share the blame by believing you could just leave and not suffer and legal consequence.

Eviction is the absolute worst because even when you pay off what is owed to the landlord the eviction does not disappear from your credit report. Public records are debts associated with courts that are reported by the government each month. The fact that you are current on your payment plan to resolve the debt is keeping the debt from being applied to your public records. The moment you stop paying it will return.

Bottom line, there is no way to have an eviction removed. Sorry.

Both of you are responsible on paying your Monthly rent. The best protection from this harsh punishment is reading your lease completely. You should read what you signing for. Leases are riddled with all kinds of rules and regulations as well as consequences, so knowing where you stand from the beginning will prevent you from being kicked out into the cold. It’s also helpful to understand the eviction process so if you are served with an eviction notice, you’ll know how to proceed, and what your rights are. Goodluck

For you to be liable in anyway, you would have had to sign the lease. Never sign anything you don't read. When you sign a lease with another person both of you are responsible for all the rent and they can go after one of you or both of you. You must have signed a lease and when you gave your word and signed the lease, you are legally responsible. You dont' get to just change your mind. There are consequences. And ignorance doesn't give you the right to not be held accountalbe. And yes, men do lie. So do women.
