Vacating apartment and giving 30 days notice middle of month, are we responsiblee for next full month rent?

Closing on home at the end of the month but of course we need time to clean up new home and get our things moved in. We are currently under a month to month lease but I expect to need first couple of weeks into next month to get things taken care of. Will we need to pay a full months rent for the couple of weeks we need to stay in current apartment, 1/2 rent even? Will we need to pay any rent if we gve 30 days notice halfway through this month. Have not given notice yet because so many things can go wrong at a closing.

Depends on the original agreement and how it was written. Talk to your landlord and tell him your situation. As long as he can get a tenant in right after you leave might not be a problem to him/her.

Yes, they can legally charge you the full month rent. Landlords are never required to pro-rate rent. If you are there one day into the month, then they can charge for the full month. Even if they do pro-rate the rent you still have to pay something. When you give 30 day notice you must pay rent through the full 30 days.





EDIT: Offering to show it right away (As someone suggested) will not get you anywhere You are required to do that anyway. A landlord can show your unit at any time with 24 hr notice starting the day you give notice.

Unless it's specifically addressed in the lease, you'll owe a full months rent next month. One way to save money is to offer to show the apartment to prospective renters right away. That way the landlord may find someone who wants to get in early, or who insists on having the place painted or some repairs done, for which the landlord will need early access. Then you are in a position to negotiate the amount you will owe.
