can i still be charged rent if i have already moved out but not passed my inspection?

I rented in NC and failed my move out inspection due to mismatched paint and it wasn't clean enough. The inspector said they would deduct from our security deposit for the cleaning and paint. Its been three weeks since I've moved out. They are still not finished with the house, still charging me rent, and told me to keep the utilities on until I've "passed" inspection. Also said they would take oust another 75 dollars to inspect it for the last time. Is this protocol?

Your rent should have stopped the day you vacated the rental unit. You are no longer staying there. Also you should turnoff all utilities in your name.



If your landlord decided to take a vacation immediately after you left he cannot charge you for rent when you are not residing there. The same with the utilities, you are no longer there, why would you pay for utilities you are not using. Call and have all utilities turned off immediately.



You should check with the local tenant advocacy group.



Your landlord normally can not charge an inspection fee. He is gonna inspect the property any way. He can collect for any damage to the property that is not considered normal wear and tear. All that remains should be returned to you. Most states or cities or local governments have a law that this any deposit returned must be done within a certain period of time.

Absolutely not. When you move out, you turn off the utilities and you don't pay rent. There is no "passing" or "failing" an inspection. They can charge you for the damage and cleanliness, but that's it. Read your lease, because unless you signed a provision that says otherwise, they're taking advantage of you. And, you don't pay for a walk-through and you're under no obligation to do a "second" walk through.

Yes because even though you don't live there anymore, until you pass your inspection no one else can yet so they charge you rent until its ready for another tenant.



Why not try doing the cleaning and painting yourself to avoid the extra costs and them deducting from your security deposit! Why didn't you clean up better before you moved out? You should of known they would inspect before you moved out completely!

Your answer rests in the legal language in your lease agreement. Your landlord can retain your security deposit until all costs related to your "damages" are ascertained. If you did not leave the premises in acceptable condition, all costs related to returning the premises to acceptable condition are yours to bear.

Did you have a signed lease? If so, when did it expire?? You should not be charged rent past y our lease expiration date. You will however be responsible for damages.
