I have a mortgage with a company for a home, however when a title search was done, by an attorney, there was no title found for that home. Is it required by law that the deed/title be filed/recorded at the proper offices so it shows up with a deed/title search? If it is required by law, is this a breach of contract by the mortgage company?

I think you are saying that the title company found no lien against your property. It would not be the mortgage company filing the transfer of ownership. If the mortgage company fails to file a lien against your property then they have lost a big advantage. You may be able to sell your property without paying off the mortgage- you would still owe the debt- but it would not be secured! The mortgage company would not like that. So I don't see how this is hurting you.

The deed is filed by the title company not the mortgage company. If you purchased the property and there is no record of that transaction, your attorney needs to straighten it out for you. The mortgage company only puts a lien on the deed. It is not like titling a car.

owe yes a deed shows that the property was rightful transferred into your name. and a deed is nee deed too show that you just didn't walk in the front door on this property and just began siting on the couch. it is nee deed too be recorded in case of real state taxes. sewer Water , bills. without it, they wont touch it.
