I have been renting an apartment unit for 2 1/2 years. I was on a lease the first year. When the second year came around the landlord said I will now be on a month-to-month basis and everything that was on the contract remains the same. The landlord has now raised the rent for tenants, except those that are on a lease. If the verbal agreement, that the same contract rules still applies to me, but she is now changing the rent, doesn't that void the contract? I also have a garage that she is now converting into a carport. Doesn't that also void the contract? Should I demand a new contract? I felt like she purposely did not want to renew my lease so she may up my rent and remove my garage without breaking any contract. So there is basically nothing I could call her out on. What to do? Hmmmm......

On a month to month lease all the terms and condition do apply BUT can be changed with a 30 day notice. You are free to agree with the changes or give notice to move out. It does not void the contract nor can you demand anything.

No, it does not void your rental agreement; it amends it.



Since you are a periodic tenant, any term in your lease can be changed with proper notice. You have the choice to accept it or to give your notice and move out.

He can change the rent at any time on a month to month verbal lease with 30 days of notice...



He could have increased your rent on renewal instead...

all things the same until she gives you proper written legal notice to change things...that means, if she informs you of changes in October, the changes start December first...if you want changes, like moving, same thing
