If a buyer submits a counter offer with a one day expiration, and it is not accepted?

by the seller, and in fact it expires. Is the buyer able to sign the previous, last offer presented by the seller because there was no expiration on it? OR does the unaccepted buyers counteroffer nullify previous offers from the seller? Help please.

A counteroffer nulls the previous offer but you can go back and offer what they offered you. You don't have anything until both parties accept and sign an offer contract

If you are using the word "submits" and the word "counter offer" as a lawyer would use it- then you probably have nullified the seller's last offer. But the seller may still be willing to agree to sell it to you for that last offer.



A seller never really has to even respond to an offer. An agent is legally required to present it- and would no longer want to have the property listed if they find the seller no longer wants to sell the house- but the seller can legally just ignore an offer- as long as they are not violating a fair housing statute.

No, the buyer cannot do so. A counter offer is a rejection of the original offer, along with a new offer from the seller. Once the counter offer is tendered, the original offer is void.

A counter offer is a rejection of your offer and it is now null and void.

If the counter is not accepted there is no contract.
